no symbol version for module_layout


Mandriva 2010.2:
I built kernel 3.1.6 on Mandriva the following way:
make clean && make mrproper
cp /boot/oldconfig .config
make menuconfig - load alt = .conf - save and exit
make
make modules
make modules_install
make install

grub edited.
kernel boots fine. but...

unfortunstely I need to load a proprietary driver. ATI, yes, the open one doesnt do what I need. In any case I strongly dislike the proprietary driver and find DKMS and kernel headers horrible. Proprietary drivers has caused me nothing but wasted time and utter annoyance.
Fglrx gives me the error "fglrx:no symbol version for module_layout".
Consequently I end up in a situation where I cannot use my ATI card properly. DRI, DRM, DPMS fails according to xorg.log. I can force load the fglrx module using "modprobe -f fglrx" then restart x. it works fine. DRI succeeds. I do not know how to use the -f option to forceload fglrx on boot and ignoring the errors, that would be fine.

but the best option would be to gigure out the vermagic issue. damn kernel headers, damn DKMS.
